Who owns the copyright of the images on this
site? The copyright of all the images on this site lies and
remains with John Ashley photography the photographer.
The free images may be used without payment providing the conditions
of use are met. A non exclusive licence is required to use any
of the other images, and this is what is purchased when you buy an
image.

Who is stock software ltd? This company
provides the website and supplies the images and invoices the
customer. Stock software is VAT registered and all cheques should be
made payable to Stock software Ltd.

What is a non exclusive licence? All JAP
material is copyright and must be licensed. A licence allows you to
use an image in a certain way once an appropriate fee has been
agreed. The licence to use an image will appear on your invoice and
will spell out exactly how the image can be used. When you buy an
image licence on this site you will receive a licence that gives you
permission to use the image on a specific website or document. The
same image may already be in use on other websites, so more than one
individual or organisation may have permission to use the image.
This is why the images are inexpensive, the cost is being shared.

Are there any limitations in the licence?
Yes, The following limitations apply:
The licence is non exclusive.
The licence is not transferable.
The licence has a duration of one year.
The image may not be used on the front or back cover of a printed
publication unless the printed publication is a single sheet.
The image may not be used for commercial use without prior consent
The image may not be used on the home page or index page of a
website.
The images may not be used for advertising purposes.
The images may not be used as banner advertisements.
The images cannot be altered or changed. (They can be cropped and
effects may be used. Tints, colour correction, conversion to
monochrome or sepia and borders are fine, but you cannot add to or
remove parts of the image)
No more than 3000 copies of the image may be printed. (This does not
apply to website use.)

How much will a licence cost? The basic
online licence fee is currently £12.00 sterling and includes Email
Delivery and VAT. The licence grants the purchaser permission to use
the image on a specific website or document for a period of one
year.

Will I be eligible for a discount? If you
require a reasonable number of images, (25 or more in a single
order) then we will supply the images on a windows compatible CD
free of charge, and are willing to negotiate special rates.

I only require one or two images but my email
account cannot cope with large attachments? We can post your
requested images ( UK only) on a windows compatible CD for an
additional charge of £12.00 Inc VAT.

Can I publish the images before I receive my
Licence?
Only the free images can be published without a formal licence
agreement, and then only if the terms and conditions have been
adhered to. Even if we have supplied an image by post or email, it
MUST NOT be published until you have received your licence and paid
the fee. If you publish an image prior to paying the fee, you will
be charged for unauthorised reproduction as defined in the terms and
conditions, we take this matter very seriously indeed.

Are any of the images available royalty free?
There are a few royalty free images on the
site.

What is a release?
A release is a documented agreement on which an individual or
property owner gives permission to the photographer for the image to
be reproduced commercially.

Do you hold Model / Property Releases for the
images on the site? We DO NOT generally hold release
documents for the images on this site, as they are mainly intended
for editorial purposes. We may hold a release for a specific image,
but it is the clients responsibility to ensure that one exists. If
the client believes one is needed because of the use to which the
images is put, then the client MUST NOT ASSUME that one
exists.

Do I need a model / Property Release? We
cannot tell you if you require a release to reproduce an image, that
would be legal advice and we are not lawyers. It is generally
accepted that images used for news or editorial purposes do not
require a release, but often commercial use does require a release.
The main reason for needing a release is the case where an
individual is easily recognised, and may take offence at the
reproduction of their likeness. Most of the images on this site are
taken such that people cannot easily be recognised.

What is the difference e between Editorial Use
and Commercial Use? Editorial purposes means that the images are
used to support the editorial content of a magazine or news article
or website article. Commercial use is when the image is used for a
commercial purpose, for example to promote or sell goods or
services, in an advert or a brochure.
We do provide images for commercial use but these often require a
Property or Model Release. This is why the use must be confirmed
when placing an order. General shots often do not required a
Property or Model Release. However where an individual or property
can be identified a Release may be required. We DO NOT hold
Release forms for ALL the images on this site, it is the clients
responsibility to check.

How is a licence fee calculated? The basic online
licence fee is fixed and non negotiable, but may change from time to
time. The fee may be varied if special conditions are agreed in
writing, but this only applies to substantial orders.

Can I use the same image on different websites?
No, the licence is for a specific website or document.

Can I use the same image on different pages
within the same website or document? Yes.

Can I use the image more than once? Yes,
but only on the specifically named website or document detailed on
the licence. You cannot re-use the image on a different website or
domain or sub domain, or on another document.

Once I pay a licence fee, can I use the image
again and again? No, the licence will cover you for an
agreed one-time use. If you want to use the same image for a
different use later on, then there will be an additional fee to pay.
If you want to use an image for a variety of uses at the same time
(e.g. a marketing campaign) then an all-in fee can be negotiated.

How long is the licence for? The
Licence is limited by use and by time. The duration of the licence
is one year.

How are the images delivered? When an image
is purchased (or more accurately a licence to use the image) you
will be emailed an invoice, and attached to this email will be the
image. A licence agreement that proves you have been granted
permission to use the image will be sent by email when payment has
been received.

What if the email gets lost or I loose the
attachments? Just let us know and we will send you another copy.

How do I pay for the image licence? You will
receive a VAT invoice which you pay by cheque by return. We do not
offer credit!

Will the image I receive look like it does on
the website? You will receive the same image, but it is supplied
uncompressed (as taken) and un-cropped so that you can resize, crop
and compress it further to suit your own purpose. View

What are the rings on the images? There are
some rascals that surf the internet and pinch images from picture
libraries, and use them without permission, the rings and the
copyright notice prevent these individuals from using the images
without permission.

How can I easily browse all of the images? View
any image and use the next and prior links, this will walk through
the whole library.

Why are all the images on the site 6" x
4.5"? This translates to 432 X 324 Pixels at 72 pixels per
inch, this is the most convenient size for the website, because both
portrait and landscape images will fit in a browser window on most
computers. In addition the file size can be kept to a sensible level
so that the image can be evaluated, without taking to long to
download.

I want to pick and choose images from the JAP
library, and update my website with JAP images as often as I Like? We
produce a CD with all the images found on this website with a non
exclusive "blanket" licence agreement for customers that
require this level of service. The fee for this product is £1000
per annum.

using JAP, you should always read our terms and
conditions. This explains the way we do things and any
restrictions you might encounter.
